By accessing or using CyberHost Pro LLC's hosting services, website, or related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and CyberHost Pro LLC ("CyberHost Pro," "we," "us," or "our").
If you do not agree to these Terms, you may not access or use our Services. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.
2. Description of Services
CyberHost Pro provides web hosting, virtual private server (VPS), dedicated server, domain registration, and related internet services. Our Services include:
- Shared web hosting with cPanel control panel
- Virtual Private Server (VPS) hosting solutions
- Dedicated server hosting and colocation
- Domain name registration and DNS management
- SSL certificate provisioning and management
- Email hosting and anti-spam services
- Content delivery network (CDN) services
- Backup and disaster recovery solutions
3. Account Registration and Security
To use our Services, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your contact information remains current
- Complying with password security requirements
4. Acceptable Use Policy
You agree not to use our Services for any unlawful purpose or in any way that violates these Terms. Prohibited activities include, but are not limited to:
- Hosting or distributing illegal content, malware, or viruses
- Sending spam, bulk email, or unsolicited communications
- Violating intellectual property rights of others
- Engaging in hacking, phishing, or other security attacks
- Using excessive server resources that affect other customers
- Adult content, gambling, or illegal pharmacy websites
- Cryptocurrency mining or similar resource-intensive activities
5. Payment Terms and Billing
Payment terms are specified in your service agreement and invoice. General billing terms include:
- Services are billed in advance according to your chosen billing cycle
- Payments are due within 15 days of the invoice date
- Late payments may result in service suspension or termination
- Setup fees, if applicable, are due upon service activation
- Refunds are subject to our 30-day money-back guarantee policy
- Prices may change with 30 days advance notice
6. Service Level Agreement (SLA)
CyberHost Pro guarantees 99.9% network uptime for our hosting services. SLA terms include:
- Uptime measurement excludes scheduled maintenance windows
- Service credits provided for verified downtime exceeding SLA
- Credits calculated as percentage of monthly hosting fees
- Claims must be submitted within 30 days of the incident
- Maximum monthly credit is 100% of hosting fees
7. Data Backup and Recovery
While we provide backup services, customers are ultimately responsible for their data:
- Daily automated backups are provided as a courtesy service
- Backup retention periods vary by hosting plan
- Customers should maintain independent backups of critical data
- CyberHost Pro is not liable for data loss or corruption
- Backup restoration may incur additional fees
8. Intellectual Property Rights
CyberHost Pro respects intellectual property rights and expects customers to do the same:
- You retain ownership of content you upload to our servers
- You grant us license to host and deliver your content
- You must have rights to all content hosted on our services
- We may remove content that violates intellectual property rights
- DMCA takedown procedures are followed for copyright claims
9. Limitation of Liability
To the maximum extent permitted by law, CyberHost Pro's liability is limited as follows:
- Total liability shall not exceed fees paid for the affected service
- We are not liable for indirect, incidental, or consequential damages
- Business interruption, lost profits, or data loss are excluded
- Force majeure events are excluded from liability
- Some jurisdictions may not allow these limitations
10. Termination
Either party may terminate the service agreement under certain conditions:
- Customers may cancel services with 30 days notice
- We may suspend or terminate for Terms violations
- Immediate termination for illegal activities or security threats
- Data may be deleted after account termination
- Refunds are subject to our refund policy terms
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Texas, United States. Any disputes will be resolved in the state or federal courts located in Austin, Texas. Both parties consent to the jurisdiction of these courts.
